Amy Wallace & Yellow Journalism

On October 17, 2009 I was at the Atlanta airport on my way back to Washington, D.C. when I stopped at a newsstand. Like most weary travelers waiting for a plane, I was looking for something to read that would give me a break from my work, which included, two weeks earlier, hosting the large Fourth International Public Conference on Vaccination 1 for an audience of 700 concerned scientists, health care professionals, journalists, legal experts, ethicists and parents from around the world.

Suddenly, my eye caught the distorted, photo-shopped image of a baby with the word FEAR in bold letters imprinted on the baby’s chest. I paged through Wired magazine2 to find out who wrote the article and discovered it was a woman named Amy Wallace, one of the many journalists I had talked with in 2009, who had contacted the National Vaccine Information Center3, a non-profit, educational organization I co-founded in with parents of vaccine injured children in 1982.

As I scanned the article to find out why it was entitled “An Epidemic of Fear: One Man’s Battle Against the Anti-Vaccine Movement,” I quickly realized it was a puff piece for vaccine patent holder, Dr. Paul Offit, who alleges that vaccine injuries and deaths are largely a myth.
Then, I saw my name. And then, I saw the words, “She lies.”

I felt a knot in the pit of my stomach as I read the unsubstantiated, unchallenged slur made by Offit against me. And in those two words “SHE LIES,” I knew that the propaganda tactic of character assassination was being used to attack the credibility of my nearly 30 years4 of work as a vaccine safety consumer advocate.

Now, I have never met Amy Wallace. We have never shaken hands or shared so much as a cup of coffee together. We had one interview on the telephone in 2009. In a sworn statement5 she stated that she did not use any quotes from our telephone interview in her Wired article. No, she didn’t.

She also did not tell Wired readers what I told her, which is that I have always encouraged everyone to become educated6 about the risks of diseases and risks of vaccines and consult one or more trusted health care professionals before making an informed decision - just like every intelligent person should do before using any pharmaceutical product. Instead, Ms. Wallace said she based her description of me on a speech I gave at a conference, a speech that she did not attend.

Nobody at Wired magazine called me while they were presumably fact checking Wallace’s article to ask me point blank, “Dr. Offit said that you lie. Do you have a response?” Wouldn’t a responsible journalist or editor have made some attempt to verify such a serious attack on another person’s character? No, Dr. Offit’s defamatory statement remained in the article, unchallenged.

I was left with two options: 1) I could ignore it; or (2) I could take action to defend my integrity. After consulting Jonathan Emord7, a constitutional and libel law attorney, I selected option number two. I sought justice in a civil court, which is my constitutional privilege as an American citizen and my responsibility as the president of a non-profit organization, whose supporters depend upon the accuracy, honesty and integrity of what I say and do, as does everyone I know.

Requesting a jury trial in a U.S. civil court to sue for slander or libel is not for the faint of heart. You have to review and be prepared to defend the truthfulness of every statement you have ever made and every action you have ever taken in your life. You, your family, friends and colleagues could be subpoenaed and drawn into a potentially very public, drawn-out battle, especially if those you are suing are wealthy, influential and politically connected.

I had never sued anyone before and I certainly never thought I would find it necessary to sue a journalist. The majority of journalists I have worked with over the years have been honest men and women, who have taken care to do their research and fairly report the facts without prejudice, including accurately describing who I am and what I do.

This was different. I had never been defamed before and I knew I had no choice but to take steps to defend my integrity. I was confident that, if my case was presented to a jury of my peers, I would win. I had no doubt I would win on the facts because I do not lie and there was no evidence that could be produced to substantiate the defamatory statement made by Offit, amplified by Wallace, and printed by Wired magazine published by Conde Nast.

After Mr. Emord filed a Complaint with Demand for a Jury Trial8 on Dec. 23, 2009 in a Virginia U.S. District Court asking for one million dollars in damages, we waited for a response from the defendants. When I read the Motion to Dismiss brief filed on Jan. 22, 20109 by the defendants attorneys, I could not believe what I was reading. That CYA brief is better reading material than anything I can write or say here.

Instead of providing one piece of solid evidence to support Offit’s defamatory statement, Wallace claimed I could not sue her because she is a resident of California. And Offit, who has no trouble keeping a straight face when he states flatly that it is absolutely safe for a child to get 10,000 vaccines at once and 100,000 vaccines in a lifetime, claimed he was simply having an emotional meltdown when he hysterically told Wallace “flatly” that I lie. And to draw attention away from the seriousness of engaging in libel per se, the defendants’ attorneys argued that “the quoted remark ‘she lies’ is not capable of being proven true or false” because the civil court system cannot prove whether vaccines do or do not cause harm.

In my Opposition to Motion to Dismiss brief filed on Feb. 3, 201010, Jonathan Emord and his associates brilliantly outlined why it is inconceivable that the self characterized “dispassionate, objective” Dr. Offit described by Wallace in her article as a “mild mannered” rational man of “science,” suddenly would have lost his mind when maliciously calling me a liar. Mr. Emord points out that it is far more logical to conclude that Dr. Offit knew exactly what he was doing.

Mr. Emord also makes a compelling argument that Ms. Wallace knew exactly what she was doing when she wrote an article “void of balanced criticism” that set me up for ridicule as a person “unworthy of any professional association.” Mr. Emord rightly stated that the libel lawsuit we filed was not about “the intellectual debate surrounding vaccination,” it was about proving before a jury of my peers that Offit and Wallace defamed me in order to discredit my long, successful public record of consumer advocacy to defend the informed consent ethic in medicine11.

On February 12, 2010, the case was argued in front of Judge Claude Hilton, a Ronald Reagan federal court appointee. On March 10, 2010, a Memorandum Opinion12 was issued by Judge Hilton granting the defendants’ Motion to Dismiss.

In his opinion, Judge Hilton explained why he would not allow me to face my accusers in a court of law in front of a jury of my peers. First, Hilton said that protection of First Amendment free speech rights are “at their zenith” in this case because Paul Offit and I are public figures debating an issue of “substantial public concern.” Second, he said there would have to be a discussion about “which side of this debate has ‘truth’ on their side” and that would be impossible to prove based upon a “core of objective evidence.”

Third, Hilton offered the opinion that Offit’s allegation “cannot be reasonably understood to suggest” that I am “a person lacking honesty and integrity” and that Wallace and Wired magazine were only reporting Offit’s “personal opinion” about my “views” and none of the defendants intended to make a “literal assertion of fact” that I lie.

In other words, they really didn’t mean it.

Seriously. That was the substance of their main defense – they really didn’t mean it – and Hilton bought it. However, if all three defendants really didn’t mean it, as they claim in their legal brief, then, ethically, all three defendants should have stated so publicly in a clarification published in Wired magazine to correct the public record. That has not happened.

I weighed the option of taking the case to the federal Court of Appeals, where a three-judge panel would have reviewed Hilton’s opinion and had the opportunity to overturn it, as has happened in the past. However, if Hilton’s opinion were overturned on appeal, my case would have gone back to Hilton’s court for a jury trial and he would have been the presiding judge with an obvious bias.

So I did not appeal and moved on. However, Ms. Wallace continues to paint herself as the innocent victim of an uprovoked libel lawsuit, even as she becomes the shameful face of yellow journalism13, a nasty, lowbrow kind of tabloid reporting that “exploits, distorts or exaggerates” to create “sensation and attract readers.”

In an August 30, 2010 article14 published on the Internet, Wallace addressed fellow journalists about the difficulties of being sued for libel and complained about being called bad names by grieving parents of vaccine injured children, whom she had cruelly demonized in her article. Casting herself as a martyr with Offit for the cause, she said “The beast doesn’t tire, it seems, of taking whacks at those who dare to describe it” and suggested that she had been vindicated by Hilton’s opinion and the inclusion of her Wired article in an upcoming book on Best American Science Writing edited by a doctor with financial ties to the pharmaceutical industry, including vaccine manufacturers.

Sadly, Wallace is looking into a mirror when she describes the “beast.” She, Offit and Wired magazine have feasted on the shattered lives of vaccine injured children and their parents to sell magazines. They have taken delight in belittling vaccine victims and those who are trying to help them, while defending bad science and one-size-fits-all vaccine policies that create more vaccine damaged children every day. Amy Wallace, who wrote an article full of factual errors and silly quotes from a doctor hyping vaccine mandates like a used car salesman, is a classic example of the bully who can dish it out but sure can’t take it.

During the 1980’s, 1990’s and early 2000’s, I worked with award winning,15,16 truly professional print and broadcast journalists,17,18,19,20,21 who were committed to maintaining high journalistic standards and intelligently covering all sides of the multi-faceted vaccine safety issue. They did not sensationalize and dumb down the conversation to a black and white, “pro” and “anti” slugfest that is the hallmark of tabloid journalism.

There are fewer smart, responsible investigative journalists writing about the science, policy, law, ethics and politics of vaccination in America today. Perhaps that is because, today, health journalists are being warned by those in positions of authority to only report one side of the vaccine safety story.22

Do I regret my libel lawsuit, even though I didn’t get my day in court in front of a jury of my peers to prove who is lying and who is not? Not at all.

I know I did the right thing when I stood up to these schoolyard bullies, who are desperately trying to shut down all public discussion about vaccine risks, a subject that public opinion polls reveal concerns more than 50 percent of Americans today.23 Perhaps that is because, today, nearly everybody knows somebody who was healthy, got vaccinated, and then became sick or disabled for the rest of their life.

Doctors, journalists and judges in denial cannot change that harsh reality. It is a reality that the American people are not going to tolerate for much longer before they rise up, break free, and take back their health and their choices.

New Vaccine Science Can Help Bridge the Divide

Fear of the unknown is what terrifies us the most, fear of being unable to have control over what the future holds. At the root of that fear is knowing that the choices we make today could have a profound impact on what happens tomorrow. 1 Fear is a strong emotion that helps people take action but fear does not help people think clearly and make well informed choices. 2, 3

Fear has dominated the public debate about the risks of infectious diseases and the risks of vaccination during the past three decades. 4, 5, 6, 7, 8 Now it is jeopardizing the urgent need to create a supportive environment for researchers to conduct well designed studies to answer outstanding questions about vaccine safety, questions that the Institute of Medicine pointed out in 19919 and 1994 10 needed to be answered and that the National Vaccine Advisory Committee outlined in 2009 and 2010 during a public engagement initiative. 11

Getting lost in the avalanche of accusations, finger pointing and demonization of individuals challenging the status quo 12, 13, 14, 15 is the more important question: What can be done now to fill in gaps in the science that stand in the way of our making well informed vaccine choices and public health policy based on evidence and not fear? 16, 17, 18, 19, 20, 21, 22

On January 3-7, 2011, a vaccine safety conference was held in Montego Bay, Jamaica that included a diverse groups of delegates from around the world, including senior scientists and physicians, editors of scientific journals, experts in vaccine regulation, social science and health policy, consumer child health advocates, legal experts and members of the media. 23 Public observers in the audience included Jamaican physicians, wellness practitioners, graduate and medical students in public health programs and parents.

The international meeting was underwritten by individuals and private family foundations and co-sponsored by the National Vaccine Information Center. The goal was to further evaluate vaccine safety science and vaccine policy in light of the fact that 89 percent of recently polled American parents put vaccine safety at the top of their list of medical research priorities, 24 while health consumers in other developed countries are also questioning the quality of vaccine science. 25, 26

All of the delegates expressed concern about increases during the past three decades in the numbers of children and adults affected by immune and inflammatory diseases, ranging from asthma 27 and neurodevelopmental disorders 28, 29, 30 to the emergence of previously rare but serious autoimmune health conditions.31, 32 Many delegates presented information from the peer reviewed scientific literature and pointed out gaps in knowledge about the biological mechanisms for vaccine induced brain and immune dysfunction, 33 as well as the fact there is inadequate information about:

One: Genetic and biological high risk factors 34, 35 for vaccine injury and death;

Two: Vaccine safety data, especially for delayed or chronic health outcomes;

Three: Vaccine additives, including aluminum adjuvants, which are immune stimulating agents, as well as mercury preservatives;

Four: Multiple vaccinations given simultaneously or repeatedly over time;

Five: Bias in reporting of vaccine risks and benefits; and

Six: Novel vaccine-associated autoimmune diseases.

There was discussion about the need to identify research priorities and design studies to identify how and why some children and adults may be at higher risk for vaccine reactions that lead to chronic health problems or even death.

There was discussion about the need to minimize undue commercial and political influence on academic institutions, medical journals and lay press because it gets in the way of open, unbiased scientific inquiry, 36, 37, 38, 39 especially into important questions about vaccine safety science and policy.

Representatives of federal agencies responsible for vaccine regulation, promotion, and safety were invited to present at this important conference but declined the invitation. And that fact speaks louder than words about how great the divide is between those who regulate vaccines and make vaccine policy and the people, who must adhere to that policy.

The men and women with vision and integrity, who are stepping forward to conduct and fund independent research to fill in knowledge gaps about vaccine safety, are to be congratulated for having the courage to stand up during a time when the public conversation about vaccination is dominated by fear. Hopefully, in 2011, new vaccine science that adheres to high standards will generate evidence to help bridge the divide between those, who believe all vaccines are necessary, safe and effective, and those who have serious concerns.

The Vaccine Injured: Where Has Compassion Gone?

During this season of remembrance and thanksgiving, I am grateful for the blessings that I have had in my life, including the hard times, when I learned that faith and hope can overcome fear and doubt. Adversity can make us stronger but it is also an opportunity to feel and offer compassion to others to ease their suffering.

In great numbers,[1] Americans reach out to help victims of hurricanes,[2] floods, earthquakes,[3] poverty,[4] violence[5] and disease.[6] Journalists often profile individuals, who are suffering from adversity: the earthquake survivors in Haiti;[7] the victims of hate crimes;[8] children living in poverty dying from starvation and neglect.[9] These stories of human suffering are reminders of why we should listen to our conscience[10] and act in compassionate ways to lessen the suffering of others.

The ability to have compassion for others is an antidote to cruelty, inequality, injustice, and tyranny.

Valuing Individual Life, Freedom & Compassion

America was founded by men and women immigrants, who had personally suffered oppression and adversity, and knew how important it is to treat individuals with respect and compassion. There is a ringing endorsement in the U.S. Declaration of Independence for the individual’s right to life, liberty and the pursuit of happiness,[11] and in the Constitution for the right to freedom of speech and personal religious beliefs.[12] Perhaps it is that fundamental appreciation for the value of the individual, which is part of our history and culture, that has taught us to value conscience and compassion.

Vaccine Injured Not Treated with Compassion

So it is sad to see what happens in America today when babies, children and adults react to vaccines and become permanently injured or even die.[13] [14] [15] [16] When healthy people suffer complications from infectious diseases, they are treated with compassion.[17] [18] [19] [20] But when healthy people suffer complications from vaccination, often they are not treated with compassion.[21] [22] Many times, vaccine victims [23] [24] [25] are victimized all over again by those, who deny the reality of what happened [26] [27] [28] or use a utilitarian [29] [30] [31] rationale to dismiss them as acceptable losses in the War on Infectious Disease.[32] [33] [34] [35]

Media Failing to Protect Vaccine Injured & Safety Advocates

In the past decade, this persecution of a growing minority of vaccine-injured citizens has been facilitated by the fourth estate,[36] the free press, which has historically served as a check and balance on inequality and injustice in America.[37] The vital function of a free press, ensured in the U.S. Constitution, is failing to do what it could do to protect the health and lives of the vaccine injured[38] [39] or defend freedom of speech for citizens calling for inclusion of vaccine safety and informed consent protections[40] in public health policies and laws,[41] [42] [43] while the chronic disease and disability epidemic destroys the health and economic stability of our nation[44] [45] [46] [47] [48] and the public health community has no answers, so the band plays on.

Institute of Medicine Acknowledges Vaccine Safety Science Gaps

The Institute of Medicine issued an historic report this year that acknowledged there is not enough quality vaccine science in the medical literature to determine whether or not many of the vaccines routinely given to children and adults cause more than 100 different types of brain and immune system dysfunction.[49]

These are serious inflammatory brain and immune system disorders, which are part of the exploding chronic disease epidemic in America, and range from heart and blood disorders to strokes, sudden infant death syndrome, asthma, multiple sclerosis, fibromyalgia, GBS, rheumatoid arthritis, lupus, diabetes and encephalitis that can lead to seizures, learning disabilities and autism.

Institute of Medicine Acknowledges Individual Biological Susceptibility

In that historic report, the Institute of Medicine also acknowledged there are pre-existing biological susceptibilities that can make some individuals more vulnerable than others for suffering harm from vaccination, such as genetic variations; age or developmental stage at the time of vaccination; coinciding illness or other environmental exposures.[50]

If one-size-fits-all vaccine policies and mandates are putting an unknown number of biologically susceptible individuals at risk for injury and death, why do so few doctors care or want to do something about it?

Doctors Denying Medical Care to Families

It is disturbing to watch doctors, who we have always believed to be the most compassionate among us, coldly turn away families questioning the government policy of giving children 69 doses of 16 vaccines.[51] [52] Families wanting to choose or delay vaccines, are being denied medical care even if children have experienced previous vaccine reactions or have become chronically ill and disabled after vaccination and could be made sicker if more vaccines are given.[53]
How unethical.

Doctors Tell Employees: Get Vaccinated or Be Fired

It is shocking that health care professionals are being threatened by doctors running hospitals and medical facilities that, if they do not obey orders to get an annual flu shot, they will be fired [54] [55] [56] - even if they are pregnant; have had previous vaccine reactions or have medical conditions that could be made a lot worse if they get more vaccines.[57]
How heartless.

Doctors Strip Parents of Legal Right to Make Vaccine Decisions for Minor Children

It is hard to accept that doctors we have trusted are pressuring our elected state legislators to pass laws stripping us of the legal right to make medical risk decisions for our children so minor children can be given vaccines without a parent’s knowledge or consent.[58] [59]
How dangerous.

Pharma Funded Doctor Associations Attack Vaccine Safety Advocates

It is frightening to know that medical trade associations and doctors taking money from drug companies[60] [61] [62] [63] are mounting disinformation campaigns to demonize vaccine safety advocates[64] and censor public access to information about health and vaccination so the American people cannot make fully informed vaccine decisions.[65]
How ignorant.

Mainstream Media Facilitates Public Attacks on Advocates

And it is tragic to witness the mainstream media facilitating the public attack on vaccine victims and those calling for a move away from one-size-fits all vaccine mandates[66] [67] that punish individuals, who are biologically vulnerable to vaccine reactions in part because of the genes they inherited.[68] [69]
How cruel.

Vaccine Makers & Doctors Giving Vaccines Shielded from Liability

In 1986, Congress passed a law acknowledging that vaccines can and do cause brain and immune system damage and that more should be done to protect individuals from vaccine injury and death.[70] In that law, Congress shielded drug companies selling vaccines and doctors giving vaccines from civil lawsuits when someone is seriously injured or dies after being vaccinated.
So why are doctors, who are shielded from liability, so unwilling to treat vaccine injured children and their families with compassion or understand the need for people to have the freedom to protect themselves and their loved ones from vaccine injury?

Loss of Compassion Leads to Exploitation

When you enter the Holocaust Museum in Washington, D.C., you see an inscription that says “The first to perish were the children…. From these a new dawn might have risen.”[71]

The loss of compassion and, then, freedom in any society always begins with people looking the other way when those in power justify exploiting a vulnerable minority for what they say is the benefit of the majority.

NVIC: Three Decades of Defending Informed Consent Rights

It has been 30 years since the parent co-founders of our non-profit charity, the National Vaccine Information Center, launched the vaccine safety and informed consent movement in America. We were parents of children, for whom the risks of vaccination had been 100 percent, and we took on the mission of preventing vaccine injuries and deaths through public education and defending the human right to informed consent to medical risk-taking.

Compassionate Doctors Will Count & Minimize Vaccine Casualties

During this season of remembrance and thanksgiving, I pray that doctors developing, selling, giving and promoting the use of vaccines will stop to consider the way they are treating the vaccine injured and their families. I pray that they find it in their hearts to replace their fear, anger, doubt and prejudice with compassion and take positive steps to accurately count and minimize the numbers of vaccine casualties rather than dismissing them as a “coincidence” or unimportant.
